Disclaimer and Terms of Participation

Cycle Chala City Bacha – Zone / Ward Rides

I. DEFINITIONS

For the purpose of these terms and conditions:

C3B or Cycle Chala City Bacha refers to the civic cycling initiative promoting community-led rides across Mumbai.

Organisers include C3B, Smart Commute Foundation (SCF), the Bicycle Mayor of Mumbai, Bicycle Councillors, Ward/Zone Coordinators, volunteer marshals, and any persons involved in coordinating or facilitating C3B rides.

Participant means any individual who registers for, attends, or participates in any C3B ride, including accompanying guardians of minors.

Ride or Event refers to any cycling activity conducted under the C3B banner.

Minor refers to any Participant under the age of 15 (fifteen) years.

II. TERMS OF PARTICIPATION

1.⁠ ⁠Voluntary Participation and Assumption of Risk

Participation in any C3B ride is entirely voluntary and undertaken at the sole risk of the Participant. Participants acknowledge the inherent risks of outdoor cycling, including but not limited to interaction with vehicular traffic, adverse weather, road hazards, mechanical failure, and conduct of other road users.

2.⁠ ⁠No Organiser Liability or Insurance

(a) The Organisers shall not be liable for any injury, illness, accident, loss of property, or loss of life, whether occurring before, during, or after the Ride.

(b) The Organisers do not provide medical support, emergency services, or insurance cover of any nature. Participants are encouraged to obtain appropriate personal insurance, if required.

3.⁠ ⁠Medical Fitness

Each Participant affirms that they are medically fit, physically capable, and free of any condition that would impair their ability to safely participate in the Ride. Any health risks or conditions must be managed solely at the Participant's own discretion and responsibility.

4.⁠ ⁠Minors

Participation by Minors is permitted only when accompanied by a parent or legal guardian, who shall assume full responsibility for the Minor's safety and compliance. Unaccompanied minors will not be permitted to participate.

5.⁠ ⁠Compliance with Laws and Safety Protocols

Each Participant agrees to comply with the following safety and conduct requirements:

(a) Traffic Rules: Participants shall comply with all applicable traffic laws and obey instructions issued by marshals, coordinators, or law enforcement authorities.

(b) Protective Equipment: Helmets and Emergency Cyclist ID cards are mandatory for all Participants.

(c) Visibility: Bicycles must be equipped with functional front and rear lights for rides conducted in low-light conditions. Use of reflective clothing or accessories is strongly encouraged.

(d) Prohibited Conduct: Participants shall not engage in dangerous riding, stunts, excessive speeding, or any behaviour that endangers others.

(e) Audio Devices: Use of earphones, headphones, or personal speakers during the Ride is prohibited, as it may impair road awareness.

(f) Public Health Compliance: Participants shall comply with any applicable health advisories or pandemic-related protocols in force at the time of the Ride.

6.⁠ ⁠Consent to Media Use

By participating in the Ride, each Participant consents to the use, publication, and dissemination of photographs, video recordings, or other media captured during the Ride by the Organisers, for non-commercial promotional or outreach purposes, without further notice or compensation.

7.⁠ ⁠Participant Responsibility for Personal Readiness

Each Participant is solely responsible for evaluating their own physical condition, cycling proficiency, equipment suitability, and prevailing road and weather conditions prior to and during the Ride. Participation shall be based on the Participant's informed and independent judgment of their ability to safely complete the Ride. The Organisers shall have no obligation to assess or verify the fitness or preparedness of any Participant.

Participants may voluntarily withdraw from the Ride at any time if, in their reasonable judgment, continuing would pose a risk to their health, safety, or well-being.

8.⁠ ⁠Waiver and Indemnity

To the fullest extent permitted under law, each Participant:

(a) Waives any and all claims, actions, or causes of action against the Organisers arising from or in connection with their participation in the Ride; and

(b) Agrees to indemnify and hold harmless the Organisers from any third-party claims, losses, damages, liabilities, or expenses (including legal fees) resulting from their participation or conduct during the Ride.

9.⁠ ⁠Amendments and Right of Exclusion

The Organisers reserve the right to:

(a) amend or supplement these terms at any time, including issuing ride-specific instructions; and

(b) exclude any Participant from present or future Rides for non-compliance with these terms or for conduct deemed unsafe or inconsistent with the spirit of the event.

10.⁠ ⁠Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with participation in a C3B Ride shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
